Recorded on Friday, September 22, 2023 Audio Only Daniel J. Solove is the Eugene L. and Barbara A. Bernard Professor of Intellectual Property and Technology Law at the George Washington University Law School. One of the world’s leading experts in privacy law, Solove is the author of 10 books and more than 50 articles. He is also the founder TeachPrivacy, a company providing privacy and data security training.  Synopsis: Heidi Hurd once said that consent works “moral magic” – it confers morality, legality, and legitimacy to things that would otherwise not be without consent. Consent plays an enormously powerful role in privacy. With consent, entities can do nearly anything with people’s data. But consent in privacy is beyond broken; it is a complete fiction. Opt out consent in the US is a farce. But opt in consent in the EU is also doomed – people just click “accept” buttons without understanding what they are consenting to. Privacy issues are too complex for people to understand sufficiently, dependent on things people can’t find out, and impossible to scale. Most approaches to privacy consent try to fix it, to turn fiction into fact. In this lecture, Professor Solove proposes a radical new approach. He argues that attempts to fix privacy consent are futile. Instead, privacy law should lean into the fact that privacy consent is a fiction – it should recognize that privacy consent is murky at best. Professor Solove will discuss how what he calls “murky consent” will help resolve the intractable problems with privacy consent. For more background, you can read the paper draft here. Talk I: Copyright Challenge – A Comparative Law View on Authorship

Program occured on January 23, 2024 Event Information | Agenda | Resources Presented by Asia IP & Competition Law Center In Nov. 2023, the five-year-old Beijing Internet Court (“BIC”) issued a landmark judgment (Li v. Liu) on the copyright eligibility of an image generated with Stable Diffusion AI, finding the human user that provided elaborate prompts to the machine to be the “author”. This judgment has triggered a flurry of vigorous debates in China, and meanwhile attracted significant international attention. Some commented that this $70 ruling may have far-reaching implications on the evolution of AIGC in China, unleashing a trillion-dollar industry. Some contrasted this judgment with the various rejection decisions issued lately by the US Copyright Office (“USCO”), which found that the human users in the loop do not have sufficient authorial control, despite the hundreds of prompt inputs. The apparent disparity in outcomes however, may have largely shadowed the similarity of a human-centered approach adopted by both institutions facing a common conundrum. With the emergence of powerful Gen-AI tools and their varied synergies with human beings, we now start to witness real-world examples of “authorless works” as coined by Prof. Ginsburg and Luke Budiardjo. While these “works” may not fulfill the conventional authorship requirement, some of them may have remarkable commercial or even arguably artistic values (depending how we interpret “art”). How to properly address this common challenge faced by all jurisdictions, may require us to go beyond the doctrinal level and revisit the justifying principles of copyright law / author’s law, in light of the legal and economic context in the particular jurisdiction. In this inaugural Talk, we invited Profs Guobin Cui and Qian Wang, two renowned copyright law scholars in China, to give us a nuanced account of this case, against the backdrop of how the rapidly evolving copyright law deals with various technological challenges in China. As a comparison, BCLT’s own faculty director Prof. Robert Merges, Co-Director of BAIC, will provide his insight through the lens of US copyright law, as well as the underlying principles of intellectual property. If you are litigating in Texas or think that you could be there soon, you need Michael's unique perspective about procedures and trends. Michael also selects the key cases that you need to know about. It is like having your own personal tour guide for IP cases in Texas. In this episode: With the changes in case assignments and the retirement of Judge Yeakel, things are changing in the Western District of Texas.  We don't know exactly what happens next, but you probably want to get to know the other judges and their approach to patent cases.  Luckily, Michael is watching the entire state. What are the rules for venue this month, Judge Albright's Atlas case gives us an interesting analysis of the inevitable collisions between Fifth Circuit cases and Federal Circuit cases.  It seems clear that court congestion is no longer considered relevant when the plaintiff is a non-practicing entity. Two remedies cases--USAA and US Silica--provide great reading and a roadmap for challenging damages and seeking a permanent injunction. Finally, the court gives us a great explanation of rule 50(a) and the de minimis exception.  For those looking to preserve their appeals, this is a must read.

The Impact of Climate Change on Persons with Disabilities: Is there a role for global strategic litigation?

Five speakers from Australia, Europe, and North America discuss prospective and existing litigation that addresses the impact of climate change on persons with disabilities.   This panel brings together academics, lawyers, activists, and individuals with lived experiences to discuss existing and prospective climate litigation that addresses the impacts of climate change and climate action on people with disabilities. The panel is moderated by Dr. Cristy Clark. Dr. Clark is an Associate Professor with the University of Canberra Law School whose research focuses on the intersection of human rights and the environment.   Professor Sébastien Jodoin, Associate Professor at McGill University; Canada Research Chair in Human Rights, Health, and the Environment; and Director of the Disability-Inclusive Climate Action Research Programme (Directeur, Programme de recherche sur l’action climatique inclusive du handicap) (Professeur agrégé et Titulaire de la Chaire de recherche du Canada sur les droits humains, la santé et l’environnement).   Dr. Laverne Jacobs is a Full Professor at the University of Windsor, Faculty of Law (Canada). She is the Co-Director of BCCE's Disability Rights Working Group and Founding Director of the Law, Disability & Social Change Project. In 2022, Professor Jacobs was elected to the United Nations’ Committee on the Rights of Persons with Disabilities and is currently completing a four-year term as an expert Committee member.    Michaela Kroemer is an attorney at the law firm Krömer (Austria).   Brittni Dienhoff works closely with local communities to tackle the climate crisis. Previously, Brittni worked in private practice providing complex climate risk advice to public and private sector clients across an array of industries. Her litigation experience has included working with Traditional Owner groups across Australia on land rights issues, and at the Human Rights Law Centre. The USPTO-FDA Collaboration: Laying the Foundation for the Life Sciences Industry and Beyond

In 2021, President Biden called for action “to help ensure the patent system, while incentivizing innovation, does not also unjustifiably delay generic drug and biosimilar competition beyond that reasonably contemplated by applicable law.” In response, the USPTO and the FDA have begun an unprecedented collaboration that the USPTO believes will “strengthen our patent system for all technologies.” This webinar will explore the first steps of that collaboration and possible next steps, including:   The USPTO’s notice on duties of disclosure and reasonable inquiry, particularly with respect to statements made to the FDA. The FDA’s (and some senators’) concerns about continuation practice and the USPTO’s request for comments on that issue. The role of the PTAB in the collaboration, including the interplay between post grant proceedings at the PTAB and Orange-book listed patents and biologic patents. US-China Science and Technology Agreement 2023

Please join BCLT for an in-depth discussion on the controversies surrounding the renewal of the US-China Science and Technology Agreement. The current agreement needs to be renewed by August 27, 2023.  Our keynote speaker is Prof. John Holdren(opens in a new tab), former Director of the Office of Science and Technology Policy in the White House during the Obama administration. The agreement plays an important historical and practical role in guiding US–China cooperation on numerous shared bilateral and global challenges. It was the first bilateral agreement between the US and China. US climate envoy, John Kerry, visited China recently to seek further cooperation on global climate issues, which this bilateral agreement has governed. Nonetheless, the agreement is now the subject of considerable controversy arising concerns over whether the agreement benefits US interests, the risks of “IP Theft”, as well as broader geopolitical concerns. The newly-formed House Select Committee on Strategic Competition between the United States and the Chinese Communist Party has already “strongly recommend[ed]” that the agreement not be extended in a letter to Secretary of State Blinken on June 27. We will discuss the role of this agreement in government, public sector, and private technology collaboration between the United States and China, the benefits and challenges the agreement poses, and how a new agreement might be structured, while addressing many of the criticisms and assessments of bilateral science cooperation. USPTO’s Battle Against Fraudulent Trademark Filings From China: Origins, Strategies, and Ethics

In recent years Chinese companies have become major filers of trademarks at the USPTO. The filings have likely been in response to market demands, the growth of e-commerce, and domestic Chinese subsidies. However, the increase has also brought with it numerous unscrupulous actors on both sides of the Pacific. The result has been a surge in fraudulent USPTO trademark filings and disciplinary actions brought by USPTO, as well as cancellation of thousands of trademark applications. The increase in USPTO disciplinary activity has also come at a time that China has been increasingly concerned about misuse of IP filing subsidies and the need to increase its own controls over bad faith filings in China. These developments in Chinese trademark filings at the USPTO may lso reflects the difficulties in establishing and enforcing cross-border disciplinary rules.
